PLEASE MAKE SURE THAT YOU READ AND UNDERSTAND THESE PROCEDURES TO PREVENT THE REJECTION OF POSSIBLE CLAIMS THAT YOU MAY HAVE.
Principals and Practices
General conditions
In terms of our quality assurance policy Agricon undertakes to provide free repair and or replacement service of defective materials and or workmanship where the liability of Agricon has been approved by an authorised Agricon representative.
Guarantee, Principals and Practices
Any claims and or liability of Agricon in terms are subject to the following principals and practises:
• Agricon shall be excused of any liability under the terms of our quality guarantee if the Agricon machine to which the guarantee relates have been subject to miss use, impact, alternations, modifications or failure to apply to the operator standards including, but not limited to the standards recommended by the owners manual.
• Agricon shall be excused of any liability under the terms of our quality guarantee if the Agricon machine to which the guarantee relates have been subject to miss use, impact, alternations, modifications or failure to apply to the operator standards including, but not limited to the standards recommended by the owners manual.
• Repairs and service can only be done by qualified personal on all Agricon machinery.
• No work carried out by any third party not appointed to do so in writing by Agricon will considered for any claims. The use of such contractors will also lead to the immediate cancellation of any claims that may arise in the future.
• Should Agricon find that failure found was due to service, lubrication or any other type of misuse and abuse this guarantee will be void.
• Agricon shall not be liable for routine service and maintenance cost. Replacement of consumable parts like v-belts, roller shells, die-rings, roller bearings, bearings or any other components subject to normal wear and tear.
• This guarantee and liability of Agricon does not extend to any parts or accessories other than those parts and accessories provided and applied by Agricon.
• It is the responsibility of the owner to apply to operator standards and maintenance.
• All components and accessories that are replaced at the discression of Agricon shall become the property of Agricon.
• The guarantee and any liability of Agricon in terms of this guarantee excludes any liability for consequent loss and indirect damage of loss of production, standing time, or loss of the use of the machine and the result of loss under the guarantee.
• This guarantee shall not apply to any defects or use of any incorrect lubricants.
• The guarantee does not cover transport of equipment or parts from the site to our works in Oudtshoorn, RSA. Travelling and accommodation costs of technical personnel are not included in this guarantee and will be for the customers account.
• If a dispute should arise about a claim rejection by Agricon, Agricon has the right to request a consulting engineer, laboratory or other professional service provider to evaluate the problem. The consultation costs for such third party will be for the account of the client if Agricon is found to have been correct in the first place. If however, Agricon is found to be liable, Agricon will carry out the repair and foot the consulting bill.
Exclusions
Fan Belts - Guaranteed by manufacturer.
Electric Motors - Guaranteed by manufacturer.
Geared Motors - Guaranteed by manufacturer.
Bearings - Guaranteed by manufacturer.
Any equipment or parts not manufactured by Agricon.
Equipment manufactured for the client as a ?once off? product for which no research and development costs has been paid to Agricon.
Summary
All claims will be handled at the discretion of Agricon and the outcome of any claims will be final and non negotiable.
